Liability SKIJAR Foundation
The terms and conditions listed in this document are applicable to the holiday hereafter called SKIJAR. SKIJAR is defined as the skiing trip organised by the SKIJAR Foundation and it will take place in February 2013 including the journeys forth and back.
Article 1 Cancellation
1.1 After paying the travel expenses participation is definite. In case of cancellation (for whatever reason) the participant will have to pay his/her travel expenses unless the participant has cancellation insurance and the reasons for cancellation meet the terms of the policy. Cancellation due to illness or accidents of any nature do not form an exception.
1.2 Weather conditions such as storms or lack of snow as well as closed pistes are beyond the control of the SKIJAR Foundation. These circumstances are classified as force majeure and they do not entitle the participant to cancellation or compensation.
1.3 Early termination of SKIJAR does not entitle the participant to a refund.
Article 2 Transport
2.1 The participant is responsible for being at the designated departure point on time.
2.2 Missing the arranged group transport provided by the SKIJAR Foundation is the responsibility of the participant. In case of missed transport the SKIJAR Foundation will not refund the cost of transport.
2.3 A participant may arrange his/her own transport to and from the destination. This does not entitle the participant to a refund of (part of) the travel expenses. Organising own transport is the participants own responsibility.
Article 3 Theft and damage
3.1 The SKIJAR Foundation can in no case be held liable for theft, embezzlement, loss or damage of goods belonging to participants including the rented equipment.
3.2 The participant is responsible for his/her (rented) equipment.
3.3 The SKIJAR Foundation can in no case be held liable for damage and/or injuries inflicted by participants on other participants or third party.
3.4 The participant is responsible for activities which are not organised by the SKIJAR Foundation. The SKIJAR Foundation can in no case be held liable for anything that has taken place during activities organised by participants.
Article 4 Chalet and deposit
4.1 Before the chalets can be used a deposit of €75 must be paid in cash. This deposit will be refunded at the end of SKIJAR if the chalets are kept in a satisfactory state. The deposit also serves as a settlement as referred to in articles 6.2 and 6.3 or for any amount the participant owes the SKIJAR Foundation.
4.2 The participant is responsible for keeping his/her bedroom and bathroom clean and for any damage to these rooms. Keeping the common areas of the chalet clean and doing the washing up is the joint responsibility of all the participants of a chalet. The participants of a chalet are jointly liable for any damage to these areas or the property therein.
4.3 If the chalet is delivered in the same (clean) state as at the beginning of SKIJAR (to be assessed by the travel agent) the deposit will be refunded.
4.4 If the participant wishes to keep kosher he/she will have to take the necessary measures him/herself.
4.5 The participant must take account of the wishes of fellow participants. The participant has to avoid causing inconvenience to other participants.
Article 5 Suspension
5.1 Use of (soft) drugs during SKIJAR is prohibited.
5.2 Alcohol abuse during SKIJAR is prohibited.
5.3 Knives, guns and other weapons are prohibited.
5.4 Violation of any of the above rules can result in suspension or early termination of SKIJAR to be decided by the board of the SKIJAR Foundation.
5.5 If the participant is suspended he/she has no right to a refund of any part of the travel expenses.
Article 6 Extra costs
6.1 The participant has to bear the cost of his/her own meals. If participants in one chalet wish to share the cost of meals they must set up a kitty to cover the cost of food.
6.2 It is possible to have fresh bread delivered to the chalet every morning. The cost of this service will be deducted from the deposit at the end of the week.
6.3 It is possible to order wood for the fireplace. The cost of this service will be deducted from the deposit at the end of the week.
Article 7 Skiing
7.1 The participant is responsible for assessing his/her own level of skiing and may not endanger any person. The SKIJAR Foundation recommends taking lessons if the participant is not an experienced skier.
7.2 The rental agreement for ski or snowboard equipment is made directly between the participant and the rental company. The SKIJAR Foundation can in no case be held liable for adherence to the terms of the agreement or for compensation.
7.3 The SKIJAR Foundation advises the participants to enter only the indicated pistes. Leaving these is at the risk of the participant him/herself.
7.4 The SKIJAR Foundation can in no case be held liable for damage and/or injuries inflicted by participants on other participants or third party during skiing.
7.5 It is compulsory to have medical insurance and an insurance pass which covers skiing.
7.6 It is compulsory to carry an insurance pass throughout the entire duration of the holiday.
